PQA warrants that the items described in PQA's Process Quality Store are correctly described. The Purchaser warrants that they are authorized to make the purchase as an agent of a third party, or purchaser is personally responsible for the resulting debt and other liabilities under this purchase and sale agreement.Information supplied to, or obtained by PQA during a person's inquiry and all sales may be recorded, retained, and used by PQA so as to facilitate PQA's current and subsequent sales efforts, client support, statistical analysis, to record a person's current and future needs and preferences, industry trends, and PQA's Strategic Planning; all in accordance with PQA's policy and procedures for Personal Information Privacy and PIPED. All of the information stored by PQA is reasonably required so as to better serve PQA's prospective clients and past clients, and to help PQA run an efficient, effective, and profitable enterprise.
Goods may only be returned to PQA in accordance with PQA' Store Return Policy
PQA makes no other warranty, neither express nor implied, for the items offered, nor does PQA claim or imply fitness for any particular use. All of these documents and other items for sale are available for purchase by any and all parties through this Internet site. Some documents may be inappropriate for the purchaser's particular circumstances, and/or subject to mis-interpretation by some purchasers. The opinions expressed in PQA's documents may not be appropriate for all industries, circumstances, or organizations. Therefore the purchaser shall not solely rely upon the item(s) purchased from PQA, but shall apply appropriate due diligence, as well as seek specific analysis and recommendations from an appropriate professional that is specific and customized to the purchaser's exact needs and circumstances (not the general guidance provided in PQA's documents).
Because PQA does not restrict who purchases these items, and does not control the application of the documents and intellectual property contained or referenced therein, PQA cannot be held liable for its appropriateness, proper comprehension, application, inability of the purchaser to properly apply, or non-application. Therefore PQA has no liability nor duty of care towards the purchaser or any third party with regards to the item(s) purchased from PQA; and by purchasing one or more items, the purchaser agrees to indemnify PQA from any and all claims arising directly or indirectly from the selling, reliance upon, use, inability to use, mis-use, or non-use of the items sold by PQA to the purchaser.
PQA retains world-wide rights (including the copyright, moral rights, design, trademarks, and other intellectual property rights) to all intellectual property contained in or referenced by the embodiment(s) being sold. PQA grants to the purchaser one (1) limited, non-exclusive copyright license for each item being sold. The purchaser is not authorized to make additional copies; nor sell, share, or loan these embodiment(s) to other parties through any system or method; and the purchaser will not directly nor indirectly compete in any way with the goods or services for sale directly from PQA (whether for sale through this website, or otherwise). Neither the purchaser nor any other third party is authorized to invent or adapt PQA's intellectual properties, nor otherwise develop, use, or provide derivative works.
The above warranty, liability waiver, and copyright license are an integral part of the purchase agreement for all items available for purchase through PQA's Process Quality Store. Regardless of where the offer, counter-offer, or acceptance occurs, all sales and this agreement will be deemed to have occurred (and will be interpreted and enforced only under the laws in effect) at London ON Canada, but excludes all laws for interpretation, conflict, or use of laws in other jurisdictions. These terms can only be modified expressly in writing, and signed by the President of Process Quality Associates Inc.
